RE: APPEAL SASOL/MEAC

The previous correspondence and site visits refer. We confirm having requested, in the appeal documents and the site meetings of the 03rd and 17th June 2001, an opportunity to orally present our case, call witnesses and tender the petitions signed by the community. We confirm that you stated that you would discuss the matter with the appeal panel and revert to us. To date we have had no reply on this issue.

We confirm having requested the right to reply to the documents submitted by Sasol, DAEA and Engen prior to you making a decision on the issue. We confirm that on 13 June 2001, you stated to Mr Naidoo in the presence of Sasol Officials and Mohammed Ali of the DAEA, after taking legal advise from Advocate Seishi that those documents would be made available to us to reply. We confirm that to date we have not received those documents.

We believe that denying us the right to reply is a fundamental irregularity. We believe that the decision of the appeal should be set aside and reconsidered once we have replied. We request that you do not permit the gas to be commissioned until Tuesday the 10 July 2001, by which date we will institute the review application. We look forward to hearing from you urgently in this regard within 24hrs failing which an application for a review of the appeal documents will be made to the Supreme Court. We trust that this will not be necessary.
